Terms and Conditions
The terms for using this website and for working with Cogniden.

1. About these terms
These terms apply to your use of cogniden.com (the “Site”) and to the services Cogniden (“Cogniden”, “we”, “us”) provides to clients (“you”). By using the Site or engaging us, you agree to them.
Each project is also described in a proposal, quote, or statement of work (a “Proposal”). If a Proposal or a signed agreement says something different from these terms, the Proposal or agreement applies for that project.
2. Using the Site
- You may browse the Site and share links to it. You may not copy, download, or reuse its videos, design, or text for commercial purposes without our written permission.
- Don’t misuse the Site: no attempts to break its security, overload it, scrape it at scale, or send spam through its forms.
- Information on the Site, including service descriptions and results shown in case studies, is general and may change. It is not an offer or a guarantee of specific outcomes for your project.
3. Services and scope
We provide post production, product motion design, AI assisted creative production, social media management, and web development. The deliverables, timeline, number of revisions, and fees for each project are set out in its Proposal. Work outside that scope, including extra revision rounds or new deliverables, is quoted and billed separately.
4. Your responsibilities
- Provide materials, feedback, and approvals on time. Delays on your side may move the delivery date.
- Make sure you own or have permission to use everything you send us, including footage, music, logos, images, and trademarks, and that using them in your project won’t infringe anyone else’s rights.
- Review deliverables before publishing them. You are responsible for the claims your content makes and for meeting the rules of the platforms you publish on.
- Give us any access (for example, to social accounts or hosting) securely, and only as much as the project needs.
5. Fees and payment
Fees, deposits, and payment schedules are set out in the Proposal. Unless the Proposal says otherwise, invoices are due within 14 days, and ongoing monthly services are billed in advance. We may pause work while an invoice is overdue. Fees exclude any taxes, which are added where they apply, and third-party costs (such as stock footage, music licences, fonts, software, hosting, or paid AI tools) unless the Proposal includes them.
6. Revisions and approval
Each Proposal includes a set number of revision rounds. A deliverable counts as approved when you confirm it, publish it, or don’t request changes within 7 days of delivery. Changes after approval are treated as new work.
7. Ownership of the work
- Your materials stay yours. You give us permission to use them only to deliver your project.
- Final deliverables: once you have paid in full, you own the final deliverables we create for you, except for the items below.
- Third-party assets such as stock footage, music, fonts, plugins, and templates are licensed to you on their owners’ terms, not owned by you or us.
- Our tools and know-how, including templates, presets, code libraries, and working methods we use across projects, remain ours. Where they are part of your deliverable, you receive a permanent licence to use them as part of that deliverable.
- Working files (such as project files and raw edits) are not included unless the Proposal says so.
8. AI assisted production
Some work uses AI tools as part of our process, always under human creative direction. Legal protection for AI generated material varies between countries and is still developing, and AI output can occasionally resemble existing material. We review our work with care, but we can’t guarantee that AI assisted elements are eligible for copyright protection everywhere. Tell us before the project starts if your brand or industry restricts the use of AI.
9. Showing the work
After a project is public, we may show it in our portfolio, on social media, and in pitches. If your work must stay confidential, tell us before the project starts and we will agree that in the Proposal.
10. Confidentiality
We keep your unpublished work, business information, and account access confidential and use them only to deliver your project. You agree to keep our pricing and non-public methods confidential too. This does not cover information that is already public or that we must disclose by law.
11. Cancellation
Either side can end a project or ongoing service with written notice: 30 days for monthly services, or at any time for a one-off project. You pay for work completed up to the end date and for any costs we have already committed to. Deposits cover work already started and are non-refundable unless the Proposal says otherwise. We may end a project immediately if invoices remain unpaid after reminders or if these terms are seriously breached.
12. Warranties and liability
We will perform our services with reasonable skill and care. We don’t guarantee particular results such as views, engagement, rankings, or sales, since these depend on many factors outside our control.
To the extent the law allows, we are not liable for indirect or consequential loss, such as lost profits, revenue, or data, and our total liability for any project is limited to the fees you paid for that project. Nothing in these terms limits liability that cannot be limited by law.
The Site is provided “as is”. We try to keep it accurate and available but don’t promise that it will always be error-free or uninterrupted.
13. Other websites
Links to other websites and platforms are provided for convenience. We are not responsible for their content or practices.
14. Privacy
How we handle personal information is explained in our Privacy Policy.
15. Governing law and disputes
These terms are governed by the laws of the country in which Cogniden is registered, unless a Proposal specifies otherwise. If a disagreement comes up, we will first try to resolve it together in good faith before either side takes formal action.
16. Changes to these terms
We may update these terms from time to time. The version on this page applies to new projects and to use of the Site from the date shown at the top. Projects already under way continue under the terms agreed when they started.
